PinPatch provides an embeddable widget and web dashboard that enables users to collect, manage, and respond to visual feedback on web preview sites. The Service includes:

• AI-powered analysis and categorization of feedback
• Image upload and annotation capabilities
• Team collaboration features

3. Account Terms

3.1 Age Requirement

You must be at least 16 years old to use this Service.

3.2 Account Information

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Account Security

You must notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use

You agree not to use the Service to:

• Upload malicious code, viruses, or any harmful content
• Harass, abuse, or harm other users or individuals
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or servers

5. Widget Installation and Use

5.1 Installation Permission

You are solely responsible for ensuring you have the necessary rights and permissions to install the PinPatch widget on any website. You must be the owner of the website or have explicit permission from the website owner to embed third-party code.

5.2 Widget Behavior

The widget is designed to operate within its own context and not interfere with your website's functionality. However, we are not responsible for any conflicts or issues that may arise from installing the widget alongside other scripts or services on your website.

5.3 Third-Party Sites

Installing the widget on websites you do not own without permission is a violation of these terms and may result in immediate termination of your account.

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to the feedback data, images, and content you submit through the Service. By submitting content, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

6.2 Our Platform

PinPatch owns all rights to the Service, including the widget code, dashboard, branding, and any features or functionality we provide. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.3 Trademarks

"PinPatch" and our logo are trademarks of PinPatch. You may not use our trademarks without our prior written permission.

7. Payment Terms

7.1 Billing

Paid plans are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual).

7.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You are responsible for all charges incurred prior to cancellation.

7.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

7.4 Price Changes

We reserve the right to change our pricing at any time. If we increase the price of your plan, we will notify you at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

We comply with GDPR and other applicable data protection regulations. You have the right to access, rectify, or delete your personal data at any time.

9. Service Availability

• Damages resulting from third-party conduct or content

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

You agree to indemnify and hold harmless PinPatch and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit through the Service

12. Termination

12.1 By You

12.2 By Us

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users.

12.3 Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. We will delete your personal data in accordance with GDPR requirements and our Privacy Policy. We may retain certain data as required by law or for legitimate business purposes.

13. Changes to Terms
